Definitions and Interpretation

In this Agreement the following terms shall have the following meanings:

“Account” means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and / or any communications System on the Web Site;

“Carrier” means any third party responsible for transporting purchased Goods from our Premises to customers;

“Content” means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

“Goods” means any products that Analogue Cameras Limited advertises and / or makes available for sale through this Web Site;

“Service” means collectively any online facilities, tools, services or information that Analogue Cameras Limited makes available through the Web Site either now or in the future;

“Payment Information” means any details required for the purchase of Goods from this Web Site. This includes credit and debit card;

“Purchaser” means any person or business that buys Goods Analogue Cameras Limited from this Web Site;

“Purchase Information” means collectively any orders, invoices, dispatch notes, receipts or similar that may be in hard copy or electronic form;

“User” / “Users” means any third party that accesses the Web Site and is not employed by Analogue Cameras and acting in the course of their employment; and

“Web Site” means the website that you are currently using (www.analoguecameras.co.uk) and any sub-domains of this site unless expressly excluded by their own terms and conditions.

International Customers

If Goods are being ordered from outside Analogue Cameras country of residence, import duties and taxes may be incurred once the Goods reach their destination. Analogue Cameras is not responsible for these charges and we undertake to make no calculations or estimates in this regard. If a Purchaser buying internationally, they are advised to contact their local customs authorities for further details on costs and procedures. The Purchaser of the Goods will also be the importer of record and as such should ensure that the purchase is in full compliance with the laws of the country into which the Goods are being imported. Please be aware that Goods may be inspected on arrival at port for customs purposes and Analogue Cameras gives no guarantee that the packaging of the Goods will be free of signs of tampering.

Intellectual Property

Subject to the exceptions in Clause 5 of these Terms and Conditions, all Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Analogue Cameras. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other laws.

Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Analogue Cameras.

Third Party Intellectual Property

Unless otherwise expressly indicated, all Intellectual Property rights including, but not limited to, Copyright and Trademarks, in product images and descriptions belong to the manufacturers or distributors of such products as may be applicable.

Subject to Clause 6 you may not reproduce, copy, distribute, store or in any other fashion re-use such material unless otherwise indicated on the Web Site or unless given express written permission to do so by the relevant manufacturer or supplier.

Fair Use of Intellectual Property

Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

Use of Communications Facilities

When using the enquiry form or any other System on the Web Site you should do so in accordance with the following rules:

Obscene or vulgar language must not be used;

Content that is unlawful or otherwise objectionable must not be submitted. This includes, but is not limited to, Content that is abusive, threatening, harassing, defamatory, ageist, sexist or racist;

Content that is intended to promote or incite violence must not be submitted;

It is advised that submissions are made using the English language(s) as we may be unable to respond to enquiries submitted in any other languages;

The means by which Users identify themselves must not violate these terms of use or any applicable laws;

Users must not impersonate other people, particularly employees and representatives of Analogue Cameras.

Our System must not be used for unauthorised mass-communication such as “spam” or “junk mail”.

You acknowledge that Analogue Cameras Limited reserves the right to monitor any and all communications made to us or using our System.

Accounts

In order to purchase Goods on this Web Site Users are required to create an Account which will contain certain personal details and Payment Information which may vary based upon a User’s use of the Web Site as we may not require payment information until a purchase is to be made. By continuing to use this Web Site you represent and warrant that:

All information you submit is accurate and truthful;

If you are buying on behalf of your employers, you have the authority to submit Payment Information where any such authority is required; and

You will keep this information accurate and up-to-date.

Your creation of an Account is further affirmation of your representation and warranty.

It is recommended that you do not share your Account details, particularly your username and password. Analogue Cameras Limited accepts no liability for any losses or damages incurred as a result of your Account details being shared by you. If you use a shared computer, it is recommended that you do not save your Account details in your Internet browser.

If you have reason to believe that your Account details have been obtained by another without consent, you should contact Analogue Cameras immediately to suspend your Account and cancel any unauthorised purchases that may be pending. Please be aware that purchases can only be cancelled until they are dispatched. In the event that an unauthorised purchase is dispatched prior to your notifying us of the unauthorised nature of the purchase, Analogue Cameras Limited accepts no liability or responsibility and you should make contact with the Carrier detailed in the Purchase Information.

When choosing a username Users are required to adhere to the terms set out above in Clause 9. Any failure to do so could result in the suspension and/or deletion of your Account.

Payment

Payment shall be made by the Customer for all monies owed to Analogue Cameras in respect of orders for Goods.

Payment shall be made on order and all major credit and debit cards (MasterCard, Visa, and Amex) and PayPal.

Any and all invoices are due for payment on the date shown on the invoice, unless alternative arrangements have been agreed between the Purchaser and Analogue Cameras Limited.

Pricing

All prices on the website are in pounds sterling and include VAT.

Prices and Stock Availability

Prices are subject to Stock Availability: In the unlikely event that an incorrect price is shown on our website Analogue Cameras reserve the right to abstain from fulfilling the order at that price. You will of course be notified by phone or email at which point you will be informed of the correct price and given the choice to proceed or cancel the order.
Stock Availability: Goods are also for sale in our retail premises as well as online. In the unlikely event that an item becomes unavailable at or just before the time of purchase from the website, an alternative product or a full refund will be offered.

Carriage and Delivery

Delivery cost – United Kingdom – £6.95, Rest of the world – £60.00

International orders – Import duty and fees will need to be paid by the purchaser. These costs are different from country to country and we would not be able to advise what they would be for you. If a purchased item is faulty, please return the item declaring on the customs forms that it is a return, otherwise we can be charged import duty.

Warranties

All goods come with a full one-year warranty except film or if stated otherwise.

Returning Equipment

If the goods you purchased from us are faulty, please send them back to us as soon as possible and we will endeavour to fix the issue. If it is beyond repair you are entitled to a replacement or full refund. The returning item however will need to be in same condition as when it was purchased.

You are also entitled to a 14-day approval (not trial) period. If you wish to return the goods, they must be returned with a note stating why you have returned the equipment.
